pennys charges should be dismissed. he should be given a medal. and the da and prosecutor should be charged and tried for brining this case.

@derekwatson449 correct. which is why penny (and the others) released his grip when cops showed up and took custody of neely. who was responsive and refused treatment. depends on their reasonable belief that he was going to wake up and continue attacking. you do not have to wait for someone to resume attacking you before you can defend yourself. its shocking to me the number of perp apologists defending this menace to society.

@derekwatson449 nope. he was a known menace. neely was responsive when cops took custody of him and refused treatment. so, youre the one making things up. penny absolutely released his grip when cops showed up. actually cops refused to perform life saving measures after they took custody due to fear of disease. so why are you defending neely and making things up then? your own bias?

self defense and defense of others isnt murder. and yes punching senior citizens, attempting to push people on the tracks, and attemtping to abduct a child makes one a criminal.

i guess a bunch of people dont know its ILLEGAL to threaten people on public transport and that neely was responsive enough to refuse treatment when police took custody of him and that he died in custody.

@derekwatson449 the best predictor of future behavior is past behavior. if a know perps threatening people and is known to have committed assault in the past its 100% justified to defend oneself or others. you can 100% say "this person was previously convicted of assault and was threatening to assault more people so i defended myself and others." penny may not have been aware but other riders were. neely was a well known menace. from other reports about the trial.
