  4. Battering someone physically is assault :P . Indeed: even touching someone at all without their consent is assault in a court of law. That's why in my country a Policeman can physically detain you if given reason to do so, but a PCSO cannot (and if the latter were to try [outside of self-defence or protecting somebody else] they can be sued for assault).

  6. ^ Nope. In UK Law physical contact without consent is Assault. Trying to punch someone but failing to make physical contact is only Attempted Assault. As for threatening to assault someone, that's its own seperate type of crime. Policemen will also rarely bother with a case unless physical contact - thus actual assault - has been made. How other countries define it though... is not my forte.

  7. O~oh ad homeniem. So edgy! (and cliche). The long shadow of Bliarism on law is a disturbing one, but irrelevant here, especially as the US has been into such instututionalized affirmative action since the '60's (markedly before the illness spread over here and accross the channel). I stated the fact of how Assault is defined in my country, as US Law isn't my specialty. (nor could it ever be, with that rather bizarre inter-conflicting muddle of federal and state laws they have)
