  14. They werent focused on whether or not he was guilty of insurrection because thats not the question the SCOTUS answers. They are only addressing the Constitutionality of a lower courts ruling. In other words the question they have to answer is not whether insurrection was committed but whether a state has the right and authority to essentially determine it had and remove said offender from the ballot. The question for SCOTUS would have been the same regardless of whether or not he had been deemed guilty of insurrection, its about governments authority not the crime itself.

States can pass legislation to regulate firearm sale, possession etc like age restrictions on purchasing, prohibiting convicted felons from purchasing or possession or requiring a permit to concealed carry for example. No state has the authority to ban the sale, possession or use of firearms in general as that would be a violation of the Constitution. In fact one could argue, and many do, that any/all of these regulations are unconstitutional.
