  1. Here in the US incompetent to stand trial means they cannot adequately participate in their own defense which means they cannot be guaranteed a FAIR trial. It is the law that you be given a FAIR trial regardless of whatever the crime youre being accused is. Its a pretty high threshold to be deemed incompetent to stand trial. Or at least it used to be. And they would be sentenced to a psychiatric hospital instead of prison.
