Yeah, the argument made by her lawyer is something an ambulance chaser would do. But, I think the driver was off with saying he had very tired tires. That could be a safety issue with the car regardless of the weight of the people in the car (I interpret as he said his tracks in the tires were worn, why is probably why Lyft left him to dry). Having concern for the capacity of the suspension would be more adequate and reasonable I believe.
