There is a lot to it, but in the end it has to be equal across the board. Trump has not been convicted of any crimes to kick him off of the CO ballot. Thus, by CO voting laws he should remain on the ballot.

@donixion4368 what is the standard of determining if someone committed an insurrection or participated in one? Do to that you need to use the 5th amendment which is due process. Same with determining if someone is a felon to strip them of their 2nd amendment right. You can't just say someone participated in an insurrection and take them off of the ballot. With your standard we can do that with Biden, Harris, Newsom if he decided to run, etc. No need for an investigation, evidence, a hearing, trial, etc. Just saying someone participated in an insurrection and boom, they are off the ballot. That is why we have due process.

@donixion4368 let us go farther, the 13th amendment. Slavery is banned unless it is for punishment. How do you determine if someone loses their right to not be enslaved? Via due process. Why not say Trump now needs to be a slave to be punished?

@donixion4368 that is not due process. There was no investigation, no hearing and plea, no trial with a jury. Trump was not able to state his case. There were no witnesses called. Thus, Trump was not found to have committed an insurrection. We have a court system with due process for a reason. That prevents rogue judges from just making rulings with no hearing and trials. You are saying it is OK for judges to label someone guilty without allowing that person to state their defense and have their peers decide. That is placing a lot of powers in the hands of judges making them dictators. Oh the irony in your standard.

@donixion4368 and again, you have to be convicted of an insurrection via due process and a trial, the 5th and 6th amendment. Tell me, where is your standard on what is an insurrection? Bernie Sanders said in the past that republicans are dangerous leading to one of his supporters shooting two republicans. So Bernie committed an insurrection? Joe Biden supported BLM that was burning down federal buildings. So did Joe Biden commit an insurrection? By your standard they both did. When Joe Biden pushed to bypass Congress to create the vaccine mandate that, to me, is an insurrection. This is why we have standards such as due process. Without it someone can make a claim that a certain politician did an insurrection and a rogue judge can say yes and remove them from the ballot. Is that the standard you want?

So republicans are just returning the favor. So what is going to stop republicans from just saying certain democrats participated in an insurrection and have a judge of their choice agree and remove them from the ballot?

Republicans can say Harris committed an insurrection when she visited Taiwan without Biden's permission increasing tension with China and causing threat of war with China. You see how easy this can be done? This is why we have standards.

This is not the correct decision. Trump has not been convicted of participating in an insurrection. There has been no due process. Also, Jan 6th was not an insurrection. The capitol was not burnt to the ground. No politicians were harmed. Most people there were peaceful. No one had guns. It was a last minute protest (not organized), and people left in a couple of hours. People all across the board should be alarmed. This action of removing a top competitor in an election off the ballot is what authoritarian nations do like Iran or Russia. It is how Persia became Iran.

It was not planned and people left after a couple of hours. That is not an insurrection. If our government officials are scared of that then we are very weak as a nation as there are much more dangerous foreign threats than that. I am just picturing imagine if N Korea sent troops to the Capitol and caused major violence how our government will react.

@OldManYellsAtClouds breaking windows is also not an insurrection. Again, the capitol was not burnt down. They left after a couple hours. It was mainly people having a small moment of rage over the 2020 election where some decided to break things and then went home. And nothing has happened since.

A politician can give tours and take photos. Also, the layout of the capitol is well known. I can look it up on the internet right now.

@mgreg8134 he never tried to get the Georgia secretary of state to change the vote count. He asked to find more votes, not create them. He also did not bribe him or threaten him. He asked. As for election fraud, he said it was rigged and he is correct. It was based on the lies by the media on covid and racism in this nation. The censorship as well such as the Hunter laptop. And the last minute changes in voting to increase mail in ballots. If you are referring to Jan 6th, that was not planned, it was not organized. He told them to go peacefully. He never told them to be violent. He never told them to attack anyone nor the capitol. He ever tweeted for them to stop when it was happening but Twitter took it down. And after 2 hours those people left. On Mike Pence, there is a high chance Trump was not lying. This is actually very common in law. In the 90s if someone would have said gay marriage would be legal in the future almost everyone would laugh and said that person was lying. Down the line here we are.

Uh, you have the 5th amendment which is due process. Compare this to the 2nd amendment. You lose your right to the 2nd if you are a felon which happens after due process. Same applies to the 14th. Trump has not been convicted of anything. So you can't say he committed an insurrection on legal grounds.

@femazik I really do not care what Fox News says. They are inconsistent as well. I am giving you the answer. You have the 5th amendment which is due process. You can't just strip people's rights away without due process. That applies to the 2nd amendment and 14th amendment. You can lose your 2nd amendment right if you commit a felony, but to be found guilty of a felony due process has to take place. Same applies here with the 14th amendment. Also, if you want to discuss the age of an amendment there is a way to overrule amendments, with another one. So age does not matter. Again, not caring what Fox News says.

It is not anger towards the government but the idea there needs to be limits on it. Having one side push to kick their political opponents off of the ballots is how Persia turned into Iran.

@joshuadqueen we have it for several reasons. One is equal treatment under the law. Another was because it was written after the Civil War when there were people that took guns and literally got violent with the government for 4 years developing their own nation. However, there are other amendments such as the 5th and 6th. Under the 5th people are given due process and under the 6th you have a criminal trial by a jury with witnesses. None of those were offered to Trump thus you cannot say he participated in an insurrection. It is a balance and also limits on the government. People who hate Trump call him a dictator where what is going on here is pure dictatorship 101.

That is exactly right. To start, Jan 6th, if an insurrection, is the weakest of all time. It was Trump, during a rally, telling people to go peacefully which most were peaceful as we seen in the video. Yes, some were violent, but they did not have guns. No politicians were harmed. The capitol was not burnt to the ground. And in a couple of hours they left. So if Jan 6th was an "insurrection", then Biden trying to bypass congress to do a vaccine mandate or student loan repayment is as well.

You can cite the Constitution 100% and still ignore many important details. There is a reason why justices also cite court cases. The problem here is that there has been no due process with Trump. How can you say he committed an insurrection when he was never given a trial by jury and was convicted? He said "From my perspective, just because a hearing was held and (Trump) participated, it doesn’t mean that due process was observed." Justice Samour said "President Trump was not offered the opportunity to request a jury of his peers; experts opined about some of the facts surrounding the January 6 incident and theorized about the law." And this leads to where some parts of the Constitution was not cited such as the 5th and 6th amendment. One can write an opinion and cite the 14th amendment the whole time to which yes, they cited the Constitution. But they left out key parts. "Btw 2 conservative justices have previously writen about thier in depth knowledge of how presidents are not above the law to the constitution" Which I, and others agree. The problem here is that Trump was not convicted of any crime to remove him from the ballot. There was no trial, no jury selection, no witnesses called, no defense statements, etc. So you can't say Trump broke the law when he was not convicted. So this is why people, like me, are saying to take Biden off of the ballot. There is no standard to do so. You don't have to convict someone, you just have to say they did bad things and then remove him. That is the standard people like you and those 4 justices want which is a dangerous standard to set.

There have been on due process that found Trump guilty of participating in an insurrection, thus you cannot apply the 14th amendment here. Now yes, states can create their own voting laws, which I agree. But if they do that they have to enforce them equally via the 14th amendment. So if they remove Trump who is not a felon, then you basically have to remove everyone.

He never said he will suspend the constitution. He is saying democrats are doing that. On the dictator comment, he was joking because at this point no matter what he does the left will call him a dictator, Hitler, etc. Might as well go with it because some people's minds are not going to be changed. It is why he is not participating in the debates.

Because when the left compares it to Pearl Harbor and 9/11 we know how much of a dust up Jan 6th was. Pearl Harbor led to many deaths and to use dropping two nuclear bombs on a nation. 9/11 led to thousands of deaths and us entering a 2 decade war. Jan 6th was a 2 hour event of some windows being broken, only one person being killed, and nothing else.

Those who are bringing up the 2nd amendment keep in mind there is the 5th amendment which is due process. One can lose their 2nd amendment right if, via due process (5th amendment), they are found guilty of a felony. Here with Trump there was no due process to find him guilty of participating in an insurrection. Thus, the 14th does not apply here. It is not ignoring the 14th amendment but realizing there is the due process portion (5th amendment) of the Constitution as well.

It was never planned out. No one had guns. it was people releasing their anger for a couple hours and then going home.
