  34. You can cite the Constitution 100% and still ignore many important details. There is a reason why justices also cite court cases. The problem here is that there has been no due process with Trump. How can you say he committed an insurrection when he was never given a trial by jury and was convicted? He said "From my perspective, just because a hearing was held and (Trump) participated, it doesn’t mean that due process was observed." Justice Samour said "President Trump was not offered the opportunity to request a jury of his peers; experts opined about some of the facts surrounding the January 6 incident and theorized about the law." And this leads to where some parts of the Constitution was not cited such as the 5th and 6th amendment. One can write an opinion and cite the 14th amendment the whole time to which yes, they cited the Constitution. But they left out key parts. "Btw 2 conservative justices have previously writen about thier in depth knowledge of how presidents are not above the law to the constitution" Which I, and others agree. The problem here is that Trump was not convicted of any crime to remove him from the ballot. There was no trial, no jury selection, no witnesses called, no defense statements, etc. So you can't say Trump broke the law when he was not convicted. So this is why people, like me, are saying to take Biden off of the ballot. There is no standard to do so. You don't have to convict someone, you just have to say they did bad things and then remove him. That is the standard people like you and those 4 justices want which is a dangerous standard to set.
