  3. The issue is this, everyone else is talking about Trump outside of the courtroom. The purpose of a gag order is to prevent information from being spread that can influence the case. However, this case is so high profile that no matter what information, both true and false, is going to spread. This is a case that Trump is not only have to fight in the courtroom but also outside of the courtroom as there are going to be constant lies made about him by the media that will reach the jury. Also, Trump has his campaign to defend as well.

  5. A gag order is almost impossible to put in place on this case. The purpose of a gag order is to create a trial to be as fair as possible. However, this case is so high profile that a gag order will never work. Everyone is going to talk about Trump, thus Trump has the right to speak as well.
