Actually, a special council can do that. If someone's story is not matching up because of bad memory you really cannot indict them. You have no case. What will the jury think? Is he lying? Does he have a poor memory? Most likely the latter.

That is not wrong. Take the date of Beau's death. Hur brought up the question if Biden took documents as he left the VP in 2017. Biden said he remember because that was when Beau died. So Hur asked for a date. Biden said May 30. However, he died in 2015, not 2017.

Hur is correct. Biden took classified documents. He cannot indict because Biden has a poor memory. You have no case in this situation. How do you indict someone who has a poor memory? You can't. Hur did the correct thing. Pakman and his fans need to take off the bias glasses and see that.

Funny, Trump did none of those things. Also, Biden did not hand over documents without delay. His staffers did where Biden did not know they were even there as he had poor memory.

@Nick-Nasti yes he can. Lawyers do it all the time. So do judges. If they deem someone is not physically or mentally fit to stand trial they will make that decision. There is a form from the Northeast Ohio Medical University called Judges’ Guide to Mental Illnesses in the Courtroom where a judge can make a determination of someone's mental health. Same applies for lawyers. A lawyer will not bring someone to trial with the idea that a judge/jury will feel they have a mental disorder to dismiss the trial.
