@justanotheropinion5832 "I gave you the exact article and section. The constitution doesn’t require a formal conviction,"
Yes it does via the due process clause. Without due process anyone can say someone engaged in an insurrection and remove them from the ballot. That is why the SC ruled 9-0 against the Colorado ruling. They saw it as leading to chaos where states will say Biden engaged in an insurrection without due process and remove him from ballots. Is that what you want?
"There have been court rulings confirming this so don’t bother pretending"
Like the SC ruling?
"If the statute of limitations expires, it’s a bad thing for Justice. "
Not really. Unless for major felonies the purpose of statute of limitations is that someone commits a crime and they cannot be found guilty based on the resources given. Meaning the prosecutor could not prove guilt. You are innocent until proven guilty. You can't just dig up old records from years ago and then prosecute someone. It is similar to even if you committed a misdemeanor overtime people overlook it. Even something as serious as a DUI. Typically after 7 years people ignore it on your record. People make mistakes, the purpose is to show we are a very forgiving nation. If someone makes no more mistakes why punish them?
"If he takes office one way or another he can retroactively pardon himself, which is a bad thing for Justice. "
It is not bad. The point of presidential pardons is that at times the justice system fails. Also, to get a conviction expunge it requires three justices to write it off and a very strong argument for it. The president can just pardon someone who was wrongly convicted, or convicted too harshly. This is especially true if there are politically motivated conviction.
"If he takes office one way or another, he promises to execute his 922 page plan to cancel the constitution, which is bad for justice. "
Trump never said that. In fact, the SC justices, especially Gorsuch has followed the Constitution very strongly. During 2020 he wanted to send in troops to states to stop the riots but he could not as he needs approval from the governor. So he didn't. Just like he did not do any federal covid mandates as he could not, only the states could decide.
