If you read the tone of the decision, that was 4-3 vote, there was a lot of ambiguity where basically the CO SC is saying that they need to make a decision but ultimately the higher court need to decide. He was not given a trial with a plea, jury selection, questioning, witnesses, etc. Thus, on legal grounds, Trump has not participated in an insurrection. Justice Samour wrote "President Trump was not offered the opportunity to request a jury of his peers; experts opined about some of the facts surrounding the January 6 incident and theorized about the law" So yes, it is the question on if Trump participated in an insurrection. In fact, that case on Trump that he did is so weak, and really not there, which is why no one has charged him and tried to take him to court on it because it will fail. So if one is going to say Trump promoted violence and an insurrection, so did Biden, Harris and Waters. And again, Trump told them to go peacefully. " How did he give aid and comfort? Also, how was Jan 6th an insurrection? No guns. No one died except one rioter. In a few hours they left. That is not an insurrection. "He lost 60 cases where he challenged the election results and he still decided to go against the courts." What is your point? You can't challenge things in court? "We have hundreds of hours of testimony from people in his own inner circle and his staff testifying under oath that Trump knew what he was doing" They are questionable which is why, once again, there are zero charges on Trump saying he participated in an insurrection. Two big problems with them. One, a lot of them were along the lies of "well, Bob told me that he heard from Jill that Trump; did this". No direct witnesses. Next, none of those witnesses were crossed examine nor had to answer questions from Trump's defense team in court during a trial.
