Even Windows has its own official VM if I'm not mistaken. And once a console breaks, that's no one's fault. If the console requires a server to run though, that would be the console's manufacturer problem. Still, those are good points that should be taken in consideration to avoid problems in the future.

The same way that back then they had muzzle loading muskets and now there are fully automatic weapons. One could also argue that's valid for the weapons available back then as much as you rely of the meaning of words "back then". Just be aware that amendments aren't laws of physics, they are susceptible to be changed or reinterpretation.

If a better way to ensure the freedom of states is found, that amendment no longer applies. It's not about people, it's about the states. One way or another, it's not as simple as you think.
