He definitely is going to get the DUI he's definitely going to get the speeding or reckless driving he definitely can get the vehicular homicide but whether they want to bring it up a level due to all these factors he was aware of and had to know that there could be the outcoming of a bad situation in combination of it all they may be able to get a manslaughter case out of it

Yeah they're not going to get the top murder vehicular homicide DUI I can see that because either way he was driving drunk so it's a definite DUI he didn't have the intent to hit somebody but in the process he did and it did cause a death so vehicular homicide yes but they're not going to get Murder One on this

But the problem is I think the reason why they're reaching is he was driving drunk. He knew he was drunk, he knew he shouldn't be behind the wheel of a car and also he should know of what the consequences of driving drunk could cause. So we all know the possibilities of what can occur when we're driving drunk you could kill somebody you could hurt somebody and maybe that's the reason why they're trying to go to Murder One is because if you have any intelligence whatsoever you know what the consequences may be or what could happen if you were driving drunk in this case they're probably seeing the intent to murder not that he actually wanted to but he knows what the outcomes could be in the process of driving drunk

So I think maybe the top they could get is a murder too just based on the circumstances of him knowing what could occur by driving drunk plus he had no license he shouldn't have been behind the wheel of a car to begin with so if you think about it he's doing all these things that are legal he knows what the outcome could possibly be not that he's planning it to be but he knows what could occur by accident they may be able to push for murder too because of it I even maybe a manslaughter case
