When the police decided to take the criminal, destroying AS MUCH of the house as NEEDED, I say that they took cart blanche at destroying as much as they wanted, disregarding any responsibility for the property or the owners themselves. The police had a free - for - all. The police in Waco, TX waited out David Koresh for a much longer time. Weeks. Surely there are ways for an entire SWAT team to evade a lone gunman. There is only one way to shoot out of one window, and no room in any house is open on all sides so that you can defend all directions at once. You can only do that from a cupola, and most houses don't have that. A team could occupy the criminal on one side and achieve entry from another side or back door. No demolishing. The SWAT team took down the criminal easily, so it should not have required the destruction they did use. I think that this case can benefit from common sense.

I would like to see three family appeal to the US Supreme Court. Whether they get more compensation or not, ruling eminent domain would satisfy the Fourth Amendment's guarantee of security of a person's person, papers, and effects, all of which have been damaged in this case, their papers and effects destroyed and their person traumatized and security violated. This would require the government to assist such citizens in restoring their living, whether they thought the family made a better living from the new home or not. Let's face it: ten years is a long time, and much better materials are available today than ten, fifty, or a hundred years ago. That's economics.
