  3. Consider this: The federal government is a government of positive powers. In order to have power over it, it has to be explicitly granted in the US Constitution. Try to find where in there it gives the federal government the power to control who or who can't come into the nation. I can save you the time and tell you that it doesn't exist. No such law even existed in the nation for the first 99 years of its existence. It wasn't until the 1875 Page Act that the first restriction was placed on immigration.
