In the USA, a person is presumed innocent until proven guilty. Guns should not be removed from a person unless they are found guilty of a crime, or even in the case of these 'red flag laws', not until the person is found to be mentally unstable to own and operate a gun. It would be wrong to just accuse a person of being mentally ill and then take their guns away without due process, AND the person being found to be guilty and/or mentally unstable to own and operate a gun.
