  1. The thing about a tax on unrealized capital gains is that there's a pretty good chance it would pass Constitutional muster. By contrast, the SCOTUS would be unlikely to accept as Constitutional a federal tax on assets (at least that's true of the CURRENT Supreme Court); but it's much harder to argue against the Constitutionality of a tax on unrealized capital gains. [And, to be clear, I am adamantly opposed to either of these kinds of taxes].
