There is a fundamental issue that is being overlooked: These agencies are under the Executive branch of government. The Judicial branch is interfering with the Executive branch and it has no business doing so. The judicial branch, through the activist judges, is preventing the executive branch from doing its job. But, they've done it before and gotten away with it, namely with the Dreamers, created via executive order and yet when an executive order tried to rescind it the judges blocked it.
