It would go up to the Supreme Court and get thrown out. Even if they could find a statute that applied by its text, there are too many extreme problems from Trump being a former president, and the prosecutor having a very extreme conflict of interest. The president could declassify anything, documents were claimed to be covered by executive privilege and attorney client privilege. Even the conflict of interest would normally get Garland disbarred.

@patricktuorto I'm pretty sure the answer to that his "yes". A statute might bar him from it. But the Constitution lists the few criteria, over 35 years old and natural born US citizen, and the Constitution can't be overruled by statutes.

They would never get a conviction to stick. And it resulting clown show, would be a destructive disaster for the country, the Democrats, and would ruin M. Garland. 1. The case was started with the most extreme case of conflict of interest in history. Can US lawyers just pretend to ignore the legal ethics that they're all taught in law school? 2. The investigation is based on a non-criminal statutes, Records Act. 3. Trump's memo from 1/19/2021 states that these documents were declassified. If some documents mistakenly weren't declassified, that is not a crime. Because the "espionage act" requires intent, and requires one to give them to a foreign government, with harmful intent. That would be really bad for the country, but Trump wouldn't go to jail.

A conviction would never stick. The clown show in progress will even intensify if the affidavit is released. The twitter blue checkmarks are so goofy. They're "When Garland uncovers Trump for selling nuclear secrets to Saudi Arabia, punching a baby, and raping Liz Cheney, then he's going to jail."
