Bragg is prosecuting Trump for recording payments correctly according to the FEC. The FEC doesn't consider the payments to be campaign expenditures. This is the equivalent of the local DA prosecuting you for your federal taxes, after the IRS has concluded that you payed everything correctly.

@jamesmorrow1646 "For the same crimes Cohen was sentenced for." Trump didn't commit those crimes. If you're thinking the campaign finance violation, Trump can donate any amount to his own campaign. He can't be prosecuted for exceeding a limit, because there is none.

@jamesmorrow1646 1. That's in dispute. Cohen's former lawyer says that Trump didn't, and Cohen is lying. All they have are attorney checks for different amounts. 2. The FEC looked at this and concluded that the Stormy payment wouldn't be a campaign finance expenditure. 3. If Trump paid, it still wouldn't be illegal, because Trump can give any amount of his own money to his campaign. The FEC has standards for what is a campaign expenditure. If it is a payment you would make, if there were no campaign, then it's not a campaign expenditure. This came up in the John Edward trial. If the FEC considered everything a campaign expenditure, then campaigns would become a big financial grift, where everything would have to be paid with campaign money. Bragg obviously has TDS and is too dense to consider any of this.

@nunereclipsereborn Not sure what you're referring to. Ex counsel for Cohen, Robert Costello, testified that Trump didn't have anything to do with the payment to Ms Clifford, and that Cohen is lying. That's even beside the point, because if Trump did, it wouldn't be illegal. But that's how daft this is. Trump is accused of a non-crime, which a major witness says didn't happen.

There's about 5-10 things that make this prosecution total BS. The FEC doesn't consider the payments to be a campaign expenditure. This was settled in the John Edward trial. The FEC/DOJ don't want everything to be a campaign expenditure. Because that would result in massive campaign grifting. It's only a campaign expenditure if you wouldn't make the expenditure if you weren't running.
