It's totally sill to think that the authors of the Fourteenth Amendment intended states to decide who was an "insurrectionist". The amendment was written and passed in order to keep states inline during reconstruction. I'm always trying to decide whether this people are just ruthless machiavellian or if they're stupid.

@settame1 People always bring up "You can't yell fire in a crowded theater." as if that is law. That quote is from some defunct case during Willson's presidency, where the feds were locking up anti-war protesters. He was equating anti-war propaganda with yelling fire in a crowded theater. The standard for what is incitement to violence is in the Brandenburg case. It has to be a direct threat toward something.

@grimaffiliations3671 This isn't the constitution. It's also, as Democrats are constantly doing, judges acting out of the purview. As with the dumb NY prosecutor in Manhattan who thinks he gets to judge what a campaign finance expense is, rather than the FEC.
