I don't think the attorney general ever holds over when an opposing party president enters. It's the FBI director that customarily stays. Garland is out if the Democrats lose in 2024 regardless.

Every msnbc viewer always says "there is a process that Trump didn't follow". No. There isn't a process for the president.

It's settled constitutional law that the power of document classification originates with the president. Garland must know that he has no case. They possibly could get a court in DC to prosecute him, but it would go to the SC and get overturned.

So when Trump suggested that BIden be investigated for shady meddling in Ukraine politics(when Biden was out of politics) the Democrats melted down and had impeachment proceedings. Then Trump announced he's running for president and Biden's AG appoints a Special Prosecutor the next days.

I read somewhere that the DOJ has even admitted that Trump took the documents because they were considered personal, and there was no financial or spying motive---what a surprise. This is such a joke. The evidence photo the DOJ released showed Time magazine covers. Every president takes the documents they consider personal. The president has constitutional authority, the Archives and FBI do not.

Supposing you are right. The prosecutor announces close to the election that "Trump was highly irresponsible and improper with the handling of documents. But there are no charges." There must be some legal recourse to being slandered by a prosecutor like that. If you are not guilty of a crime, the prosecutor has no authority to scold you.

@crinklecut3790 He confused the AG, with the FBI director. The latter has something like a 10 year term, to emphasize the supposedly non-partisan intent of the position.
