  1. He took them when he left the Obama White House as VP. The VP can only declassify documents that the VP himself classified. So it's certain that it was illegal for Biden to take them out of the SCIF.

  2.  @bigjay875  It's unlikely that much will happen to him, though. In the Clinton administration Sandy Berger was stealing documents from the Archives stuffed in his pants.

  3. I would judge Biden on why he took these documents. My best guess is that they contained things he didn't want the Trump administration to see. Conversely, I think the whole Mar-a-Laga war between Trump and the Archives, is that the bureaucracy (Nat. Archives, FBI, DOJ) didn't want Trump declassifying documents. It was 4 years of embarrassing partisan hysterical witch hunts in the FBI.

  4. I'm forced to think that this is what they're using to cancel Biden's 2024 presidential campaign. Otherwise, Biden's staff would have quietly returned these documents to the Archives, dealing with Dem partisans the entire time. Otherwise, this is a massive self-own. They actively worked to politically weaponize the Trump documents, which normally would have been a civil law matter.
