  1. Their problem is that this case is such an obvious clown show, eg. CNN ridiculed Cohen admitting to stealing from Trump. Their whole theory, which wouldn't make sense anyways, was that Trump was in cahoots with Cohen in a hush money scheme. But at the same time Cohen was embezzling money from Trump. So it they get a conviction, or even worse sentence Trump before the appeal, it will be massive political overreach which will hurt the Democrats.
