The funny thing about the Letisha James ruling. If it get's overturned on appeal, then the plaintiff has to pay the interest. So there is a good chance Ms. James will cost the state of NY 100 million.

This is going to cost them dearly. If there were a legitimate justification, the DOJ would have released a statement. You don't make an unprecedented raid of an expresident and political rival, and remain silent, if you have the goods. If they had a justification, they'd make it public to cover their bases.

@SS-pi5sh The defendant normally doesn't take the stand when the prosecution has a weak case. And this case is extraordinarily weak. A trial is not a debate. The prosecution has to prove their case. If they can't prove their case, then the defendant normally doesn't take the stand.

So the trial had to be rushed before the election, but that standard doesn't apply to the appeal.

The interesting thing will be what happens when the appellate courts, perhaps the Supreme Court, review these kangaroo trials. Eg. Jack Smith claims judge Chutkan is "not biased", when she's on the record several times saying that Trump should be in jail. These cases are total clown shows.

@Deblanch57 So far there is no agreement to drug test. But if there were, then the results would be public, otherwise it would be the same as not doing it.

@ohmightywez The judge can't stop an appeal. But what he's trying to do (running his biased clown court) set the fine so high that Trump could not cover it for the appeal. But Trump has the money to put in bond. We really need to remove judicial immunity so these crooks can be imprisoned.

Fetterman's win makes me think of my mom taking my 93 year old grandfather to vote. She just tells him who to vote for because he's no longer all there. Democrats are comfortable doing that with people in high office.

They have removed all of the constitutional legal standards, such as innocent until proven guilty, beyond a reasonable doubt. FFS in this case the charges aren't even constitutional.

I think Garland made a big mistake with this. Even the OLC could have told him that this is a civil matter, not criminal. It's like he just forgot that Trump is an ex-president, so the legal situation regarding classified documents is completely different. And that he was breaking a 245 year precedent. I don't think he has any charge that would stick. For the Espionage Act, they would have to prove that he gave information to a foreign country with the "intent of harming the US". There's no chance of that.
