  1. Moving the boxes are legal under the Presidential Records Act. But more fundamental than that, the Constitution gives the president the power of document classification. So the P.R.A. can't take that away, thus it's as civil law statute.

  2. To even take this seriously, you have to not know that the president has unique executive powers regarding documents. The President has THE power of document classification.

  3. Dershowitz says the one serious charge in the indictment is related to the tape. But Smith isn't charging Trump over any documents at the Bedminster location. So Trump isn't even being charged over the "incriminating evidence".
