@churly9717 Incriminate himself in what? As an ex-president it's his right to have access to all his presidential records, and it was his constitutional right to declassify anything before Jan 21, 2021.

@churly9717 "but he didn't declassify them" He claims he did, so he did. The president can declassify just by saying so. The Supreme Court has ruled such in 1988. The ex-president has the right to access his records. He also has the final authority to declassify anything. So this whole thing is over records storage. And its only purpose is to help the Democrats in an upcoming election.

The president gets to decide what is confidential. So that's a meaningless statement.

They blacked it out, because the Supreme Court ruled in 1988 that the President has universal authority to declassify. He can declassify just by his actions. That case ruled that that is the presidents constitutional authority as C. in C.

@tonyatkinson2210 There should be FISA warrants there, such as the ones where FBI agents lied to judges to spy on the Trump campaign. Again, "top secret" doesn't apply to the president. The president has final authority on classification, as part of his constitutional powers as C. in C.
1
@tonyatkinson2210 He did declassify those documents. The DOJ has held them up under some statute that doesn't even apply to the WH, for redactions. And, you're lying. Kevin Kleinsmith lied to a judge to get the FISA warrants on Carter Paige.
1
@tonyatkinson2210 LOL Yeah...I'm sure that totally happened. I am so done with this anonymous source fake news bullcrap.
1
@tonyatkinson2210 There's zero evidence of "nuclear secrets" being involved in this. That was some fake news anonymous leak by the DOJ.
1
@tonyatkinson2210 LOL I'm sure she was looking for those "nuclear documents". This is such disingenuous crap. Military secrets would be at a government lab, not the WH or a residence of the president. Bill Clinton even shared nuclear technology with the Chinese, which they they used to build their arsenal. And no Democrats cared. Because nothing is genuine coming from them.
1
@churly9717 They pretty much are. He has the right to access them. And when still president he had the universal power to declassify. This is just a last ditch, desperate attempt, to take Trump down before an election the Democrats are set to lose. The election interference from the FBI is obscene.
1
They're just leaking lies, like "Trump has top secret nuclear documents". Something so super duper secret that the FBI let it sit there for 18 months with no urgency, when they had access to the room. That's how the sleaze balls in these agencies operate. They leak BS to the press, and then they cite that BS in their official documents. It's what happens when political activists are running powerful bureaucracies.
1
@lone982 They had access to the documents, liar.

@lone982 These issues have gone through the courts before. And you're totally ignorant of the Constitutional law. This question went to court when Judicial Watch sued for documents president Clinton took with them. The court ruled the following: 1) The president has sole discretion on classifying or declassifying documents. 2) The president has sole responsibility for the process of declassifying documents and how they are handled. 3) The Archives has no authority to question the president's decisions. 4) The fact that the president took the documents with him is DeFacto proof that they are not presidential records. This was a court ruling.... Not someone's opinion!

@ajsmith6816 I really hope you people convince Merrick Garland to indict. It will be the greatest self-own in American politics.

We know from established SC precedent that the President has universal authority to declassify. That's something the media keeps lying about. And one thing about these Trump "scandals" is that they always rely on media misinformation and manipulation. Trump could have just said that everything he was taking was declassified, and it would be the case. The 1988 SC case ruled that it's his constitutional authority, deriving from his Article 2 role as C. in C.
1
@ajsmith6816 That's not true. The presidents power to declassify is from his/her Article 2 powers as Commander in Chief, as ruled by the Supreme Court. As Commander in Chief the President has the final authority to declassify and classify. You guys are just flat out lying.
1
@ajsmith6816 Laws can't take away the president's authority to declassify -- that's a constitutional power, ruled part of his/her powers as Commander in Chief by the Supreme Court. I'm surprised you guys are pushing this misinformation. An indictment might be the boost Trump needs to win in 2024. Any charge will be thrown out by the Supreme Court.

That's before we knew that the FBI, and other agencies, is full of crooks who lie to judges to get FISA warrants.
