There are even rules on taking items for evidence. The warrant is supposed to list what they're looking for. And what they take needs to be catalogued as evidence.

This is going to cost them dearly. If there were a legitimate justification, the DOJ would have released a statement. You don't make an unprecedented raid of an expresident and political rival, and remain silent, if you have the goods. If they had a justification, they'd make it public to cover their bases.

@LilFisch1174 The warrant could get thrown out for being too broad. A search warrant for anything is unconstitutional. But as I've said before. This is all politics. They can't convict an ex president of having classified documents. The president can declare anything unclassified, for any reason. And essentially just saying it's declassified makes it so. This is in Supreme Court rulings. Even if Garland got a conviction, it would be thrown out by the Supreme Court, and he'd have massive egg on his face. In normal times an AG would never do this, because of those reasons. These Democrats are just rabid dogs with no self-awareness. Why is the left arguing for more government secrecy, and stricter classification? Are they now opposed to releasing the Pentagon Papers? It's going to be the GOP after 2024 that does massive declassification, of FBI, CIA, NSA documents. And the Democrats are going to do everything to stop it.

@jamesjenkins9918 That's not true. The warrant names thing like "box of documents". This isn't going anywhere. Because the president has the ultimate constitutional authority over classification -- not the National Archives. Here's the Supreme Court: "The President, after all, is the ‘Commander in Chief of the Army and Navy of the United States’" according to Article II of the Constitution, the court’s majority wrote. "His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant." Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, said that such authority gives the president the authority to "classify and declassify at will." The constitution trumps any legislation. If they want to go down that road and try to prosecute Trump, it would be a disaster for the Democrats. Getting the FBI involved in their political machinations was already a massive overreach.

"What I don't understand is why are they delaying releasing information." They're delaying because they have no justification. This was a political operation like the Carter Paige warrant that FBI agents lied to get. Democrats are strategically stupid. They're in an ideological bubble and didn't realize this would help Trump, big time.

The TDS Democrats are dummies. This was just about storage/archiving documents. That's something every ex-president does. When a president leaves all the documents are just packed up and moved to a private place. They're sorted out with cooperation with the Nat. Archives. Sources also say that this was a due to a mix up in the DOJ. Garland didn't approve it. That's why the DOJ is silent. These idiots boosted Trump's candidacy and gave the GOP a mandate to clean out the Dem ideologues out of these agencies next year. Good.

@Jinglejang I didn't say they announced it in advance. My point is that they made the most unprecedented raid in decades. The DOJ doesn't send the FBI to raid the house of an ex-president and leader opposition party's house and take it lightly, unless they're stupid. This is a boondoggle for the DOJ. If they had a justification they would be making it to the press, and not keeping silent. They have a serious PR problem, and are making no effort to get ahead of it. They F-ed up big time. This was a huge screw up, because an ex-president having a classified document is equal to a parking ticket. Every president takes all their documents when they leave and puts them in storage. Then they work with Nat. Archives over storage. The Democrats are in for some serious trouble. A party using the FBI against their political opposition is an extreme breach of ethics. People will get fired next year.

You can't prosecute an ex-president for classified documents. Because he had the constitutional authority to declassify anything he wanted to. He also has a security clearance.

@thetruthfornow6045 But this is backfiring spectacularly BECAUS the justification was the handling of classified documents. That in itself is a self-own, and is why the DOJ is silent about this. They're embarrassed and trying to come up with damage control. Raiding an ex-president over an archive/records issue is like raiding someone over an overdue library book. Trump could declassify anything before he took it.

@maxsmart8954 They did in this case. The DOJ is even blaming this on the FBI. There's finger pointing in the agencies, because this was a massive error in judgement. This wasn't even theft. All presidents when they leave, have the WH staff pack up all the documents and put them in private storage. Then their staff works with the Nat. Archives. Most of it ends up in the presidential library. This was a f-ck up. Leftoids are slow to catch on. They're in a bubble, so they lack acumen.

The fact that the DOJ has not issued a statement, proves there is no justification. If there were a legitimate justification they would have at least made a statement to the press, to prevent PR damage. I think this was really just a major strategic blunder on their part. Democrats are strategically very dumb.
