  2. The Founders knew about this dirty legal tactic 250 years ago, and thus prohibited it in the Constitution. The prosecution doesn't specify the crime the defendant is accused of. It's done so the defense can't mount an effective defense. If he defends against crime X, the crooked judge will instruct the jury to convict on crime Y.
