  3. It will be, eventually. These are all very constitutionally flawed cases. Like he said, this is an attempt to criminalize the right to petition the government. That right is explicitly in the 1st amendment. This used to be the norm, before about 1600 in English law. One would petition the king with a complaint. If he didn't like it, you would get thrown in the dungeon.
