They don't have a case with the Mar-a-Lago documents either. The Supreme Court has consistently ruled that the president has plenary power to declassify, that's a Constitutional power of the president, not the FBI or Archives.

@terrencekane8203 You seriously think Trump is going to be successfully prosecuted because he didn't put a sticker on the documents saying "declassified"? That's almost as dumb as the people who think he's going to be prosecuted by Alvin Bragg. Even the lame case he had fell apart completely.

@jordansche I'm amazed at how people can just swallow media lies. What would "nuclear documents" even be? The WSJ reported in November that that was BS. An no, there are not different rules. The Constitutional rule for the president is that he has plenary power to declassify or classify.

@Shaunjohnson885 Biden's documents were taken from SCIFs when he was Senator and VP. Only the president has declassification authority. It doesn't matter if Trump is investigated for this. Any conviction for it will be overturned in higher courts. The Constitutional law is settled. Document classification power originates with the Presidents Article 2 power of the Commander In Chief. Some dumb judge my even convict, but the higher courts will overturn it. It's also why, under normal times (before the rise of Idiocracy Dems) that presidential records archiving is a civil matter, not criminal.

@davids.2703 Trump didn't testify. The president can declassify through his actions. A common lie you hear in the media is that "there is a process". The President's constitutional power doesn't depend on a "process". If say Reagan wanted to reveal key secrets of SDI to Gorbechev, he could tell him, and it would have been a declassification. That's why all these media Trump scandals fail. If it goes to court it's not going to be CNN's BS about classified documents, but constitutional law. Clinton took tapes from the WH in a sock. He was sued. And the judge ruled 1) By taking them he was declaring them personal items. 2) The act of removing them was a declassification. 3) This was all his call, not the Archives or anyone else.

They don't even have a weak case. Cohen's former lawyer wrote a letter to the FEC stating that Cohen is a liar and Trump had nothing to do with the Stormy Daniels payment.
