  1. Responsibility for what? He didn't do anything related to this. He did not record the supposedly "false" business record, company comptroller did that. And no crime has been specified. They're leaving that to the jury which is unprecedented in American law.

  2. That's not the way it works. The prosecution has to make a case, then the defendant mounts a defense. When the prosecution is this weak the defendant does not take the stand.
