Indictments mean diddly. The jury only hears the prosecutions case, with all exonerating evidence excluded.

The president, under the Pres. Records Act, takes all the documents he wants to keep. They are declassified and stored. The president decides what he keeps, not the Nat. Archives.

You have to not know the procedures and law regarding presidential records. Presidents, under the Pres. Records Act, declassify everything that they take. The president chooses which records they keep, not the Nat. Archives or FBI. There are rules, such as no records can be destroyed, but it is not a criminal process.

@yapdog The Presidential Records Act is not a criminal statute. You don't "obstruct justice" over a non-criminal statute. It just lays down some rules for storage of presidential records, which are all declassified btw. Everything taken from the White House is declassified. Pence and Biden were possessing classified documents, as they had no power of declassification. Returning them means nothing. Biden illegally possessed classified documents for decades.

@scoobysnacks The Presidential Records Act is supposed to make the records available to the public (eventually). It's not a tool for the FBI and Nat. Archives to hide them.

That's the joke. Biden didn't have authority to declassify. Trump obviously declassified everything he took. That's what presidents always do, under the presidential records act.

This is also ignoring the Presidential Records Act process, just to create a partisan attack against Trump. A president, since the Pres. Records Act was enacted, always declassifies and takes all records from their administration they want to keep. Everything taken is declassified. The Nat. Archives doesn't have authority over what the ex-president keeps, he just cannot destroy anything. Some tape where Trump says "this is classified' doesn't mean it is classified. If Obama said "There are classified documents in the Chicago warehouse storage, it wouldn't make it classified. This is not a serious case.

@hermanmiller3708 "there is enough in the indictment to convict him" The indictment isn't evidence. It takes evidence to convict someone. This is just fake media bs. Records that are taken are always declassified. If, for example, Obama said there were classified documents in storage in Chicago over the phone. It wouldn't make him guilty of a crime. Because those records are not classified.

@googlechicken LOL And Trump admitted to asking the Russians to find Hillary Clinton's deleted emails. The recording isn't a legally binding statement. These people are Stalinists. They don't care whether he broke the law. Some large percentage of a president's knowledge is info that is "confidential, classified, top secret". I'm willing to be that the directive to fire withhold the 1 billion loan to Ukraine until the prosecutor was fired was classified. But Biden joked about it on camera. And it was classified because it was in exchange for a bribery payment from Burisma.

The documents weren't illegally taken. Under the Pres. Records Act the president takes any records that they created to be preserved. They are all declassified. The law just says that the records can't be destroyed, and that they eventually have to be made available to the public. BTW. Obama's records still haven't been made public after 7 years. This is all BS, meant to stop Trump. None of this is a criminal procedure. It's a civil law process for presidential records.

Because they're not running against the Democrats. Well, Pence is, but he has no chance of winning. This is so blatant. Under the Pres. Records Act, when a president leaves office he takes records he wants to keep, and all of it is declassified. Trump didn't take classified documents. The media is lying. Under normal procedure, i.e. just what Obama did, he declassified all of it.

@yapdog Trump had the right to take those documents. Under the Presidential Records Act procedure the president takes records they created. They are all declassified and put in storage. The Nat. Archives has no authority over what the president takes. They just can't be destroyed, and have to be stored properly. The intent of the law is to make the records open to the public. That's the opposite of the FBI and Archives, which wants to hide documents embarrassing to Democrats.

@james1527 The PRA states that the president decides what are personal records and what are presidential records. It states that the "presidential records" are to be made accessible through FOIA. This indictment is obviously a political hit job, for one reason it doesn't even mention the Presidential Records Act. But if they want to play like this. Biden will get prosecuted for taking bribes. We'll see which Democrats can be locked up.

The law also doesn't effect the fact that he had plenary power to declassify anything. That's why this is just a media crime, that was taken up by the DOJ out of desperation. Presidents always take all their record, that they want to keep, under the Pres. Records Act. and it is all declassified. All presidents have lawyers, and they know this. Trump obviously declassified all of it, because that's what they always do. Obama has millions of documents in a warehouse, and it's supposed to be made accessible to the public under the same act. And, likewise, it's all declassified.

This is kind of like a dog chasing a car. If the Democrats are successful, and there is only one major party candidate on the ticket, then the US will be an international embarrassment. They will have turned a developed republic in to a Latin American or African republic.

Um...the Presidential Records Act is intended to make presidential records public. Its intent was not to keep secrets.

The story doesn't even make any sense. The procedure under the Pres Records Act is that the president declassifies and takes all records he wants to possess. The Archives assists in storage, and they are supposed to eventually be made public (Obama's are still not public after 7 years). He obviously declassified everything he took.
