There's so many layers of BS that Bragg uses to make a case. That Giuliani saying it was a hush money payment (which is legal) isn't a problem for Trump. The problem is with Bragg, and Cohen's letter that says that Trump had nothing to do with Cohen's payment. So what if Trump did make the payment? The DOJ didn't prosecute because election law doesn't consider such payments to be campaign contributions (see John Edward case).

Each case is a made up media crime. In GA all his lawyer has to do is play the full phone call. In the documents controversy the Supreme Court has ruled that the president has plenary power to declassify. Bill Clinton won a civil case over taking tapes, so obviously Trump would win a criminal case.

@artbargra I don't know what that means. Particularly Democrats don't realize how extraordinarily weak this is. Not only is Bragg using a contrived novel theory to even construct a case. Cohen is a completely unreliable witness. His lawyer sent a letter to the DOJ in 2018 stating outright that Trump had nothing to do with the payment. So to recap. Bragg has a new theory on how he can prosecute Trump for a federal crime in State court, and use a clause to raise it to a felony, even though the statute of limitations has expired, there is no crime to use to raise to a felony (the DOJ never prosecuted Trump), their main witness is proven liar/perjurer whom the DOJ wanted nothing to do with, the "alleged" payoff is not a campaign violation by precedent (i.e. John Edwards trial), and there is evidence that Trump had nothing to do with the payment. Trump isn't the one in trouble here.

Don't you guys ever feel silly doing this? This case has already completely fallen apart. Bragg is not looking for an exit, because a prosecution would probably get him disbarred. They have a letter from Cohen's lawyer saying that Trump had nothing to do with the payment and Cohen is a liar.

@Enyavar1 Correction, Bragg was planning to to indict Trump. But the case completely fell apart when Cohen's former lawyer testified on Tuesday. Trump foresaw this, so he got ahead of the media cycle. Trump won this, and Bragg has egg on his face.

The FEC has guidelines to what is a campaign expense and what isn't. Hush money payments are not, if it something the candidate would normally pay for.

@danielgodfrey4415 The people cheering this don't seem to realize that Stormy Daniels and Michael Cohen are total publicity seeking liars. Daniels even published a signed letter in January stating that the affair never happened. And Cohen's lawyer testified on Tuesday that Trump had nothing to do with the payment. You can't prosecute when all the prosecution witnesses are liars who have admitted to being liars.

@Enyavar1 People were expecting the grand jury to indict. Because you can get a biased jury to indict just about anyone. But the last witness completely destroyed whatever case they had. So Bragg can continue and ruin his career, or look for and exit that minimizes embarrassment. He's likely doing the latter.

First, they don't have anything. Second, you can't "just lock him" in the US. One can only be sentenced if they are convicted of a crime.

Um...no. There's a letter from Cohen's lawyer that says that Trump had nothing to do with the payment to Stormy Daniels. The msnbc audience doesn't seem to realize that Cohen is a pathological liar. They have no case on something that isn't illegal. And if it were, would be punished with a fine by the FEC.
