Pakman really just lies. The word is in quotations because it's in dispute what is classified. And Constitutional law gives the final authority of classification to the president. If Trump declassified the documents before Jan 21, 2021 then they're declassified. See Department of the Navy v. Egan :: 484 U.S. 518 (1988).

@Roses-lilac Trump declassified the documents when he was president. That brings up another stupid aspect of this. There is a tradition of civility when there is a transition of power. Maybe think ahead. In a couple years there's going to be another president that's more likely going to be GOP. You guys would throw a fit if he raided Biden's documents. There's plenty to investigate him on: payments from foreign countries through Hunter, using the DOJ to attack political opponents, requesting that corporations censor during the campaign.

Except, Pakman is lying by omission. The president has the final power of classification. That's why this isn't going anywhere, but will die in the courts. When Trump moved those documents, he had the power over what was classified.

@BOTGRINDER "yeah but he cant just blurt it out" Actually, he can. This came up in 2018 when Trump talked to some Russian ambassador. People were trying to make another scandal out of him giving some secret. But even Politico's fact check says that the president can declassify anything, just by talking. It's not something you can make a criminal case out of. Trump can just say the docs were declassified. He does have memos for at least some.

The authority of classification rests with the president. Your comment is a miss. It's not the janitor, nor FBI, nor the Archives, that has final authority on classification, but the president. Does Pakman always play dumb? "Who else gets to make that determination?" The ultimate decision on classification rests with the President. In other words, up to January 21, 2021 it was Trump who decided what was classified.
