You have this in reverse. Trump's classified documents "scandal" was nothing, because he had plenary power to declassify. And the documents were in a secure facility at Mar-a-Lago. There's a SCIF there. When there's an argument between an ex-president and the Nat. Archives the courts and constitutional law sides with the ex-president. Biden has none of those justifications. He had no power to declassify as Senator or VP and they were not stored securely.

Except he has to leave out important legal facts to make this case. First, Trump had the constitutional authority to declassify anything. Second, the documents were stored in a locked facility. Mar-a-Lago has a SCIF. None of that is true in the Biden scandal. So either the Democrats are canceling Biden before 2024, or this is a massive self-own.

@violindylan It's not legislation, but Constitutional law. Look up Supreme Court 1988 ruling in Department of Navy v. Egan. The power of document classification originates with the Presidents authority as Commander in Chief given in article 2 of the Constitution. The president has plenary power to declassify. He pretty much can declassify a document just by saying so. Because the power originates with the president. The VP can only declassify documents that he himself classified. It's amazing how people run their mouthes on things without knowing anything.

@violindylan There's also a summary of this on the 2017 Politifact "Does the president have 'the ability to declassify anything at any time'?" The thing about people not looking up the basic facts, is that they still determine the outcome. But that leaves you with a delusional viewpoint. For example, Garland isn't going to indict Trump over the documents, because he'd only embarrass himself in court.

The funny part of this controversy. Is that "national security" is not jeopardized by any of this. But the Biden admin, DOJ, FBI, made a big deal out of what is a civil law matter -- presidential documents -- just to go after Trump. This created a massive self-own for the Biden administration. Biden is actually guilty of crimes.

@dflo4165 That's the thing about watching Dave Pakman. It gives you no knowledge of the subject. The president IS the top authority on document classification. (see above comments) An activist legal group sued Clinton for taking tapes from the White House. The judge ruled that the act of taking the tapes was de facto declassification. By do that Clinton declared them personal belonging. And as president Clinton had the authority to do that.

You guys seem to forget that team Trump would be happy with both Biden and Pence going to jail.
