  1. The DOJ cannot prevent him from being elected. These cases just ignore the constitution and precent, and will be thrown out on appeal. Eg. The SCOTUS standard for incitement is established, "Brandenburg", and Trump speech is not anywhere near the legal line. He would have had to tell the crowd to break into the capitol, but he told them to "protest peacefully and respectfully".

  2. It's contradictory. Because the only reason they'd do this prosecution is to cover up the obvious fraud. It's illegal to usher observers out of the vote counting, and it was illegal to not grant Trump's team a court hearing on the vote.
