Firing a "warning shot" at someone is not legal. There are legal reasons a cop never fires a warning shot at someone. You're either legally justified in using deadly force or not. Firing in someone's direction is assault with a deadly weapon. It's legal if it's self-defense, but a "warning shot" doesn't qualify.

manic hispanic The legal situation is that you have to be justified in killing someone to fire a "warning shot". That's why cops don't do it. And I think if you apply for a conceal carry permit the instructor will tell you to never do it. It's the same reason cops don't aim for the leg. There's no such thing as "I was shooting only to wound him" defense. If you're shooting at someone, you're trying to kill them.

Just about every Democrat opposes open carry. If a paramilitary organization is patrolling a city with guns, concern is not racist.

@seraphina985 That Marissa Alexander case was not self-defense. She left the house, got a gun out of her car and fired it in the direction of her ex-boyfriend.

@Shockguey They'll still arrest you for firing a gun into the air. I guy did it behind my dad's house. When the police came he told them "Joe Biden said to fire a shotgun into the air to scare an intruder away." But the cops still charged him with firing a gun into the air.

It's just something I'd hear from left wing activists in particular. The cops should "Shoot to wound, not kill." From the perspective of the law, every shot has the intent to kill. So there's no stage of escalation when it's appropriate to try to wound someone with a gun.

@2AForever-wi8yj I don't know. But shooting in someone's direction is deadly force. You better have a good justification for that or it's criminal.
