  2. They're people to stupid to see past what's right in front of their face. If you make theft a fine only offense it will obviously become a racket, where the fin is just considered a tax. For example, if you made it just a fine to smuggle cigarettes in to NYC. Then that's going to be an industry, because if they don't get stopped too often, the fines will be less than the taxes.

  3. The Democrats are really destroying their brand. They don't always win, even in CA and NY. There was an incompetent mayor of NYC in the early 90s that lead to Giuliani and his crackdown on crime.
