  8.  @GavinShowell  Right, but that's true for any overtake, but that doesn't make it dangerous in and of itself. He could see the offside of the carriageway was clear, and the high speed made it arguably less dangerous as he was able to return to the nearside in a short time.

Well, there would be a nasty accident, but if someone tries burning down a petrol station, should the petrol station be liable for placing a highly flammable liquid where people could commit arson against it? Likewise, if a person travels the wrong way down a racetrack, causing a collison, who is responsible, the racer or the person going the wrong way? Besides, there would be 2 cars and therefore the energy would be dispersed among them, so the closing speed would in fact be 125 mph.
