@kovuk9 what he means is the right cops have to disarm an individual during a traffic stop for safety does not give them a warrant to search the vehicle or bag for other items other than weapons. This was probably a 4th amendment violation unless the dude told them he had drugs.

@MrTruckerf safeties are stupid and unnecessary on handguns. The holster is the safety.

Since it was off body carry outside a holster the gun should have been unloaded.

@Cmac1328 you are correct but the driver has no obligation to talk to the police or tell them if he's armed or not.

@kovuk9 You're correct about the discovery while conducting a legal search. The drugs were not in the same pocket as the firearm. They removed the firearm and continued to search the bag which was outside the scope of the safety exception to the 4th amendment during traffic stops. Regardless of other "indications" they must have probable cause not reasonable suspicion to search the vehicle.

Was that all weed? Are we really throwing someone in a box for 10 years for having weed while carrying a constitutionally protected firearm? It wasn't even that much. I also know people who weigh the stuff they buy to make sure they're not getting ripped off. They have no other evidence to suggest distribution other than the scale which is shaky at best.
