What you’re saying is like if the statute of limitations has ended then instead of the defence using that argument, they instead waive the statute of limitations to prove their client is innocent. If anyone had a defence attorney like that then they get fired instantly

It’s “presidential immunity “ not just immunity. “The President is immune from civil liability absolutely for suits arising from actions relating to official duties”. Now in case you didn’t understand it , trump was president at the time so it would be negligent if the defence team didn’t test this angle in a court of law , in fact I wouldn’t be surprised if this decision doesn’t end up being decided in the Supreme Court .
