@joshuamccall8043 if life was fair the ones going to prison would be the fools who allowed Neely to still be on the streets crafter 42 convictions and a track record of violence, but instead they’ll make Penny the scapegoat.

Penny’s problem was that he held the chokehold for far too long after Neely went limp. It will cost him His freedom

@bourbonstansell8823 the guy wasn’t just unconscious , he died from being strangled ( that’s what an air choke is). Also 3 guys holding him down for 15 minutes. If they were concerned he was armed it would have been easy to check his pockets . The train was also stopped with doors held wide open, so no one was keeping them from leaving

@bourbonstansell8823 mate , what part of the guy died don’t you understand?. He was a little guy and there were at least 3 guys holding him down and more there for support. Do you really think even if he did get up that he would have tried to get another 15 minutes of being choked out and held down by 3 guys?

@joshuamccall8043 the medical examiner said he died of compression of the neck: chokehold . This is is not a blood choke where you can stop blood flow to the brain and pass out in 10 seconds . This was a poorly executed and much poor painful and deadly air choke or strangulation. Neely’s throat would have been crushed and that’s why he couldn’t breathe and died.

@joshuamccall8043 he didn’t have a clue what he was doing . I could see he was trying to get the hooks in with his legs but the choke hold was horrible . The prosecution could use the fact that he was trained on how to do rear naked choke but chose to air choke him instead. ( although I just think he just didn’t know what he was doing ) This guy made so many mistakes on how he handled this situation and I feel for him but I’ve got no doubt he’s going to do a lot of time
