You did not enter into an agreement to share the proceeds with the waitress. You gave her a penny. You didn't know what it was worth when you gave it to her, but the important legal distinction is YOU GAVE IT TO HER. Of your free will. No strings attached. Thereafter, for what it's worth, 1 cent, or $1.7 million, that's her money. You can't attach strings to it ex post facto.
