  3. UPDATE: After this video, when the Supreme Court first heard James’ case in 2020, the government asked the Justices to recognize a new immunity under a law called the Federal Tort Claims Act. If the Justices approved this immunity, the door would be slammed shut on James’ case. Upon IJ’s urging, the Court declined to recognize this new immunity and instead asked the 6th U.S. Circuit Court of Appeals to hear IJ’s arguments about why it should not be applied. Unfortunately, when this case was remanded to the Sixth Circuit, it cited outdated case law to apply immunity and let the government off the hook. VICTORY: Jeremy Bennett has dismissed his federal lawsuit against the Ohio Department of Natural Resources (ODNR) after the agency removed its regulation allowing warrantless business inspections. ODNR also compensated Jeremy for his troubles—namely, a 2021 prosecution for allegedly “refusing” a warrantless inspection of his shop. “I’m glad that I was able to make changes that apply to every Ohio business required to keep records by ODNR, not just my own,” said Jeremy. “For too long, Ohio taxidermists and deer processors have been subject to search at any time. But the new regulation requires these officers to seek our consent or get a warrant before entering—which means our constitutional rights as private property owners are respected. "We’re glad that the money has been returned, but Jerry still needs to be made whole,” said IJ Senior Attorney Dan Alban. The state returned Jerry’s money with less than 0.8% in accrued interest after moving to dismiss the case, but it refuses to pay his attorneys’ fees and interest at Arizona’s statutory rate for judgments. This would leave Jerry uncompensated for the years his money was locked away and for what he paid out-of-pocket to an attorney before IJ took on his case. The case will continue as IJ has filed a motion for judgment on the pleadings and opposes the state’s motion.   92. The law says that one may not break up one’s cash deposits in amounts less than $10,000 *for the purpose of evading bank reports to the IRS*. The Dehkos have never done that, not once in 35 years. Moreover, during a routine examination less than a year before the seizure, the IRS examined the store’s bank statements and sent them a letter stating that it found no violations of anti-money laundering laws (which include laws against “structuring” deposits).

  124. Unfortunately, civil forfeiture laws have generally made it easy for governments to forfeit property—and hard for people to fight. As our report Policing for Profit documents, these laws typically set low standards of proof, so prosecutors have a low evidentiary burden to connect property to a crime. And the law provides weak protections for innocent owners whose property is caught up in forfeiture but who have done nothing wrong. Most forfeiture laws also make seizing and forfeiting people’s property lucrative for law enforcement.   125. Good question! The open fields doctrine is categorical. So it allows warrantless searches of unmarked land. And posted land. And fenced land. And cultivated land. Heck, could put up a brick wall, dig a moat, and fill it with crocodiles. The open fields doctrine would still allow police to search your land without a warrant. Read Oliver v. United States, 466 U.S. 170 (1984), for a good summary of how broad it is. As for penetrating fences, our position is that doing so would constitute a seizure, which doesn't fall within the open fields doctrine. However, some courts have actually held that officers can break down gates to enter private land under the doctrine. See Moher v. United States, 875 F. Supp. 2d 739 (W.D. Mich. 2012).

  134. The open fields doctrine is the product of decades of bad Fourth Amendment judging. Fortunately, some states (like Tennessee) provide greater protection than what the U.S. Supreme Court currently says about the Fourth Amendment. IJ is currently defending landowners’ rights to be secure from similar warrantless intrusions in Louisiana, Pennsylvania, and Virginia, with the Pennsylvania Supreme Court likely to hear argument later this year.
