Punishment for crimes is all over the map, and broadly has more to do with how rich you are and how big the budget for the prison system etc. is (or, in some cases, how big of a scam the private owners are running) than any moral philosophy. There's plenty of evidence that in many places punishments are quite a bit harsher than crimes warrent. The problem is usually that there are a lot of perverse incentives in place that encourage police and court systems to not actually put in the efforts necessary to produce the swift and just outcomes required for a justice system to actually Work, or to Cheat in ways that undermine it. You're not wrong (or at least, mostly not wrong) regarding parenting and discipline of children though. There's actual evidence that some reform was often needed regarding 'this is acceptable and works, this isn't, this is how you do things so you're not causing more harm than good' and so on... the baby was very much thrown out with the bath water in many cases, unfortunately.
