This is a civil court matter on whether Trump had violated the 14th Amendment Section 3. In civil trials the determination of guilty is more likely than not; in criminal trials it’s beyond a reasonable doubt.

@paulaitix77 It's section 3 about fitness for office. The US Supreme Court will decide on section 3, not section 5. The section 3 has been used since the Civil War.

@paulaitix77 Even Trump's own lawyers have been arguing against section 3 and have never mention section 5 in their arguments for disqualification from the election ballot.
