  1. Prosecutor Jack Smith is doing a preemptive strike on Pence’s “Speech and Debate” clause and going directly to the courts before Pence’s lawyer. Pence is saying that on January 6 he was not part of the Executive branch but a part of the Legislative branch and should be covered by the “Speech and Debate” clause. Senator Lindsey Graham tried to evoke the clause when he was subpoenaed by the Georgia grand jury, the US Supreme Court ruled that Senator Graham had no special privilege and was force to testify.
