There is no client attorney privileged communication in a conspiracy involving a client and an attorney. All communication involving the crime between them will be submitted in court as evidence. He agreed to turnover documents to the DA.

Chesebro was required to give a video proffer in the negotiated plea. The defendant is legally required to tell the truth and not withhold any relevant information. A proffer is unique in that the defendant essentially incriminates themselves by openly talking about both their role in and their knowledge of the crime committed and others involved. If the negotiation fails because the defendant doesn’t have any useful information, his incriminated testimony against himself and others can not be used in court. If he doesn’t truthfully testify in court against others, the plea deal is broken and he can be charged with further crimes and any light sentencing agreement is void.
