  1. Confederates weren’t charged criminally after the Civil War but weren’t allowed to run for elected office per the 14th Amendment Section 3. This is a civil court matter on whether Trump had violated the 14th Amendment Section 3. In civil trials the determination of guilty is more likely than not; in criminal trials it’s beyond a reasonable doubt.
