The new Insurrection Act of 2025 would reform legislation from 1807 that provides the President broad and vague authority to deploy troops—with or without the request of a state—to suppress “any insurrection, domestic violence, unlawful combination, or conspiracy.” Under the Posse Comitatus Act it prevent the military from being used as a police force to enforce laws within the United States, the federalized National Guards will be standing next to police officers without any police enforcement powers. The civilian soldiers will basically look menacing without bullets in their weapons’ magazines standing next to armed police.
